Can you fly over my house?
Simply: Yes. Regular airplanes flow over your house don’t they? In fact, in a U.S. Supreme Court Case from 1946, gave the use of the airspace as an easement. (See United States v. Causby, 328 U.S. 256.)
The FAA has exclusive authority over the airspace above all our houses and limit drones to a limit of 400 feet above ground level.

Why would you risk, Federal Prison? Also, local laws regarding reckless discharge of a firearm could apply. Additionally, the batteries in a drone use lithium, and when they are damaged they can rapidly burn. You might be charged with arson if a falling drone starts a fire.
